NOTICE OF FINALITY OF THE BCRC DECISION
March 7, 2013
Notice is hereby given of the finality of the BCRC Decision (as defined in the Bid Challenge System Rules of MCA-Philippines) dismissing the Protest to IFB No. 110300 (Repair and Enhancement of Electronic Tax Information System). The BCRC Decision was issued on February 28, 2013, a copy of which was transmitted by electronic mail to the Challenger and Affected Bidder on the same date. In accordance with the Bid Challenge System Rules of MCA-Philippines, the BCRC Decision became final on March 7, 2013, at 5:01 p.m., Manila time.
Reproduced below are the relevant portions of the BCRC Decision dismissing the Protest:
“IV. Summary
22. Based on the foregoing, this Committee has determined that the Challenger has not discharged the Challenger’s Burden to provide sufficient information that reasonably shows that the challenged Procurement Actions taken by MCA-Philippines constitute violations of the Procurement Rules.
23. This Committee decided not to suspend the Challenged Procurement because it believes that the Protest does not clearly show that the Challenger will suffer irreparable harm if the Challenged Procurement is not suspended.
24. In view of the foregoing, this Committee hereby dismisses the Protest in accordance with the BCS Rules.”
